The Application Process

The process begins when the U.S. citizen or lawful permanent resident files an application on behalf of their spouse. Depending on where the spouse is currently located, there are two main application paths:

  • Adjustment of Status: For spouses already inside the United States, allowing them to apply without leaving the country.

  • Consular Processing: For spouses residing abroad, requiring an interview at a U.S. consulate in their home country.

Both options involve compiling substantial documentation to prove the legitimacy of the marriage and demonstrate the sponsoring spouse’s ability to financially support the immigrant spouse.

Meanwhile, spouses of green card holders may face a longer waiting period because of annual caps on available visas.

The Path to Green Card Approval

  • Immigration forms such as Form I-130 and Form I-485 (for Adjustment of Status) or DS-260 (for Consular Processing)

As of 2023, the minimum income requirement for a two-person household generally starts at $21,775. This amount may be higher depending on family size and location.

If the sponsor does not meet the minimum, a joint sponsor can assist with the financial affidavit.

The Crucial Interview

One of the most important steps is the green card interview. Both spouses may be interviewed together or separately. Officers will ask questions about the relationship, daily routines, and future plans to confirm the marriage is genuine. Following a successful interview, a conditional green card is usually issued within a few weeks.

If the marriage is less than two years old at the time of green card approval, the spouse will receive a conditional green card. After two years, the couple must jointly file Form I-751 to remove conditions and secure permanent residency.
